1. Scope and Provider
These General Terms and Conditions (AGB) apply to all contracts concluded between:

(hereinafter “we,” “us,” or “Trust Birthpools”)
and the customer (hereinafter “you”) via our website at www.trustbirthpools.com.
These terms apply to birthpool rental agreements, including the disposable kit and any optional add-ons selected at checkout. They apply to consumers and business customers alike.
Deviating terms of the customer are not recognised unless we have expressly agreed to their validity in writing.
2. Subject of the Contract
Trust Birthpools provides birthpool rental services. Each rental consists of a reusable birthpool (Mini or Regular size), a disposable birth kit (Standard, Premium, or Signature tier), and all necessary accessories for a home water birth. The disposable kit and accessories are included in the rental price and are not sold separately.
One optional add-on is available: an extra 10-metre water hose.
We do not provide medical services, medical devices, clinical advice, or midwifery services. The birthpool is rented equipment for personal use.
3. Contract Formation
The presentation of products on our website does not constitute a binding offer. It is an invitation for you to submit an order.
By completing the checkout process and submitting payment, you make a binding offer to enter into a rental contract. The contract is formed when we confirm your order by email (order confirmation). We are not obligated to accept your order.
4. Prices and Payment
All prices shown on our website are final prices in euros (EUR). No VAT is charged pursuant to Section 19 UStG (Kleinunternehmerregelung).
Payment is due in full at the time of order. We accept payment via the methods displayed during checkout (processed by Stripe). The rental period does not begin until full payment has been received.
5. Rental Period and Delivery
The rental period is anchored to your expected due date. The birthpool is delivered approximately three weeks before your due date and is to be returned within two weeks after your due date. The total customer rental period is approximately five weeks.
We deliver to addresses in Germany and Austria. Outbound and return shipping within Germany are included in the rental price. For deliveries to Austria, return shipping arrangements may differ — we will inform you of any special return arrangements at the time of order.
We make every reasonable effort to deliver on schedule. Delivery dates are approximate and not guaranteed unless expressly agreed in writing.
6. Your Obligations as the Renter
You agree to use the birthpool only for its intended purpose (water birth or birth preparation). You are responsible for setting up and filling the pool according to the instructions provided, keeping the pool and reusable components in good condition during the rental period, and returning all reusable components (pool, pump, hose, and other reusable items) promptly after use or at the end of the rental period.
Normal wear and use related to birth is expected and accepted. You are not liable for normal wear and tear.
7. Return of Rental Equipment
After your birth or at the end of the rental period, you must contact us to arrange the return. We provide a prepaid return shipping label for returns within Germany.
You are responsible for packing the reusable components for return shipment. Disposable kit items (liner, sieve, and other single-use components) do not need to be returned.
If the pool is not returned within a reasonable period after the rental end date, we reserve the right to charge a late return fee or to pursue the return of the equipment.
8. Cancellation and Refunds
You may cancel your order at any time before dispatch for a full refund. Dispatch means the point at which the carrier collects the package or the shipping label is activated.
After dispatch, cancellation is possible under the following conditions: if the disposable kit is unused and returned in its sealed original packaging, a partial refund will be issued. The refund amount for an unused kit return is €40 for Standard and Premium tiers, and €60 for the Signature tier. If the disposable kit has been opened or used, no kit refund is available.
Your statutory right of withdrawal (see our separate Right of Withdrawal policy) remains unaffected.
Trust Birthpools reserves the right to issue discretionary refunds on a case-by-case basis to maintain customer goodwill. Discretionary refunds do not establish precedent or modify these terms.
9. Damage and Loss
You are not charged for normal wear and tear or for damage that occurs during normal use of the birthpool for its intended purpose.
In the event of total loss of the rental equipment (e.g., the pool is not returned), or deliberate damage beyond normal use, Trust Birthpools reserves the right to charge a replacement fee. We will contact you before charging any such fee.
10. Liability
We are liable without limitation for damages caused by intentional or grossly negligent conduct, and for damages arising from injury to life, body, or health.
For slight negligence, we are liable only for breach of material contractual obligations (Kardinalpflichten) — obligations whose fulfilment is essential to the proper performance of the contract and upon whose compliance you may reasonably rely. In such cases, liability is limited to foreseeable, contract-typical damages.
This does not affect liability under the German Product Liability Act (Produkthaftungsgesetz).
11. Warranty
The rental equipment is provided in a clean, functional condition and is inspected before each rental. If you discover a defect upon delivery, please contact us immediately. We will arrange a replacement or repair at no cost to you.
Claims for defects in the rental equipment are governed by the statutory provisions of German rental law (Mietrecht). Claims for defects in purchased items (disposable kits) are governed by statutory warranty provisions.
12. Retention of Title
Purchased items (disposable kits and add-ons) remain our property until full payment has been received.
Reusable rental equipment (the birthpool and reusable accessories) remains the property of Trust Birthpools at all times. The rental does not transfer ownership of any reusable item.
13. Applicable Law and Jurisdiction
These terms are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
If you are a consumer resident in the European Union, you additionally benefit from the mandatory consumer protection provisions of the law of your country of residence. Nothing in these terms limits those rights.
If you are a merchant (Kaufmann), the exclusive place of jurisdiction for all disputes arising from or in connection with these terms is Göttingen, Germany.
14. Consumer Dispute Resolution
Pursuant to §36 of the German Consumer Dispute Resolution Act (Verbraucherstreitbeilegungsgesetz — VSBG), we are required to inform you: we are neither obligated nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
15. Severability
If any provision of these terms is or becomes invalid or unenforceable, the remaining provisions shall remain in full force and effect. The invalid or unenforceable provision shall be replaced by a valid provision that most closely reflects the economic purpose of the original provision.
16. Changes to These Terms
We reserve the right to amend these terms. Changes apply only to orders placed after the date the amended terms are published on our website. The version of the terms in effect at the time of your order governs your contract.
